Scope of Service
You are responsible for obtaining any equipment and Internet service necessary to access our Services and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue our Services, in whole or in part, at any time and for any reason, without notice. We may restrict access to portions of our Services, for some or all users, from time to time. Our Services may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons. We shall inform you, within twenty-four (24) hours, of a disruption or an anticipated disruption of our Services.
We reserve the right to modify or change the Website, our Mobile App, or any of the Services, with or without notice to you, and we are not obligated to support or update the Website, our Mobile App, or any Services.
Your Liquid app is a tool that you can use to pay for goods and services, or to transfer money to a registered asset manager in Ghana.
In order to use our payment services you must first open a Liquid Account by registering your details on our Website or through our Mobile App. As part of the signup process you will need to accept these
If you are an individual, you must be 18 years or older to use our services and by opening a Liquid Account you declare that you are 18 years or older. This does not apply to products for which we set a different age limit. We may require at any time that you provide evidence of your age.
You may only open one Liquid Account per email address unless we explicitly approve otherwise.
All information you provide during the signup process or any time thereafter must be accurate and truthful.
You may only add payment instruments (such as bank accounts, credit or debit cards) to your Liquid Account if you are the named holder of that payment instrument. We take any violation of this requirement very seriously and will treat any attempt to add a payment instrument of which you are not the named holder as a fraudulent act.
Maintaining your Liquid Account
You must ensure that the information recorded on your Liquid Account is always accurate and up to date and we shall not be liable for any loss arising out of your failure to do so. We may ask you at any time to confirm the accuracy of your information or to provide documents or other evidence.
We may contact you by e-mail, SMS or phone with information or notices regarding your Liquid Account. It is your responsibility to regularly check the proper functioning of your email account or other methods of communication that you have registered with your Liquid Account and to retrieve and read messages relating to your Liquid Account promptly. We shall not be liable for any loss arising out of your failure to do so.
Account funding, payments received, payments sent and fund withdrawals are displayed in your transaction history. Each transaction is given a unique transaction ID and shown in the notification history. You should quote this transaction ID when communicating with us about a particular transaction. You should check your Liquid Account transaction history regularly. You should report any irregularities or clarify any questions you have as soon as possible by contacting Customer Service.
In order to claim a refund for an unauthorised or incorrectly executed payment transaction on your Liquid Account you must notify us without undue delay after becoming aware of the unauthorised or incorrect transaction and in any event no later than thirty (30) days after the debit date of the transaction.
You must take all reasonable steps to keep your Liquid Account password and security details safe at all times and never disclose it to anyone. Our personnel will never ask you to provide your password or security details to us or to a third party. It is advisable to change your password regularly (at least every three (3) to six (6) months) in order to reduce the risk of a security breach in relation to your Liquid Account. You must never allow anyone to access your Liquid Account or watch you accessing your Liquid Account.
If you have any indication or suspicion of your Liquid Account, login details, password or other security feature being lost, stolen, misappropriated, used without authorisation or otherwise compromised, you are advised to change your password. You must contact Customer Service without undue delay on becoming aware of any loss, theft, misappropriation or unauthorised use of your Liquid Account, login details, password or other security features. Any undue delay in notifying us may not only affect the security of your Liquid Account but may result in you being liable for any losses as a result
We may suspend your Liquid Account or otherwise restrict its functionality on reasonable grounds relating to the security of the Liquid Account or any of its security features or if we reasonably suspect that an unauthorised or fraudulent use of your Liquid Account has occurred or that any of its security features have been compromised. We will notify you of any suspension or restriction and of the reasons for such suspension or restriction in advance or, where we are unable to do so, immediately after the suspension or restriction has been imposed, unless notifying you would be unlawful or compromise our reasonable security interests. We will lift the suspension and/or the restriction as soon as practicable after the reasons for the suspension and/or restriction have ceased to exist.
Funding and Transactions
You must not make transaction through a payment instrument if you are not the named holder of that payment instrument. We take any violation of this requirement very seriously and will treat any attempt to use a payment instrument of which you are not the named holder as a fraudulent act. Without prejudice to claiming further damages, if we are required to return funds uploaded from a payment instrument that is not in your name, we may charge an administration fee which will be communicated prior to.
Funding sources may be subject to limits due to security and legal requirements. These limits are set dynamically depending on your verification status and the Add Fund method you want to use.
It is strictly forbidden to use your Liquid Account for any illegal purposes including but not limited to fraud and money laundering. We will report any suspicious activity to the relevant law enforcement agency. You are prohibited from using your Liquid Account in an attempt to abuse, exploit or circumvent the usage restrictions imposed by a merchant on the services it provides.
Any funds that you add to one of your goals will be invested by one of our asset management partners, and is subject to a separate set of terms and conditions noted in the investment management agreement associated with each goal.
Any funds will be transferred from your third-party financial account (the “Funding Source” e.g. Mobile Financial Services, Bank Accounts, Debit Cards and Credit Cards) to our asset management partner.However, Liquid does not hereby obtain any rights to the principal amount of the funds it holds on your behalf.
The account at the relevant asset manager belongs to the person or legal entity which is registered as the Liquid Account holder. No person other than the Liquid Account holder has any rights in relation to the funds held in a Liquid Account, except in cases of succession. You may not assign or transfer your Liquid Account to a third party or otherwise grant any third party a legal or equitable interest over it.
You may close your Liquid Account at any time by contacting Customer Service.
If we suspect an unauthorized transaction relating to your Liquid Account or that the account was created based on fraudulent information or for a fraudulent or illegal purpose, we may freeze the account pending further investigation and may notify you of the result of that investigation.
We may charge a service fee for certain services. Other services may be offered at face value with no additional charge from LIQUID. All convenience fees are subject to change.
All transactions done using our Services are effected electronically and settled in real time at the time the transaction is initiated. All transactions done on our Services are final.
You are entitled to request a refund of your payment as the result of this agreement if the service being paid for is not received/delivered from us or the service provider. If you want a refund, you must contact us through our service channels: Whatsapp, Call center, email, or deliver your written request at our registered office.
Subject to applicable law, any requests for refund are subject to review. Depending on the service, we may refund the service fee associated with the transaction. We will not be liable for any damages whatsoever resulting from a wrong transaction. We may pass on any costs incurred for conducting a refund.
All refund requests will be dealt with high priority, and once reviewed and approved will be returned to the original source of payment (e.g. Mobile Money Wallet or Debit Card).
In case of an unauthorized payment or a payment that was incorrectly executed due to an error by us, we shall at your request immediately refund the payment amount including all fees deducted therefrom. This shall not apply: where the unauthorized payment arises from your failure to keep the personalized security features of your Liquid Account safe; if you fail to notify us without undue delay of any loss of your password or other event that could reasonably be expected to have compromised the security of your Liquid Account after you have gained knowledge of such event in which case you shall remain liable for losses incurred up to your notification to us; if the transaction was unauthorized but you have compromised the security of your Liquid Account with intent or gross negligence in which case you shall be solely liable for all losses; or if you fail to dispute and bring the unauthorized or incorrectly executed transaction to our attention within 30 days from the date of the transaction.
You may not charge back any transaction to add funds to your Liquid Account or allow a chargeback of any transaction for reasons for which we are not responsible including (but not limited to) disputes with merchants for non-delivery of goods or services. We reserve the right to charge you fees and expenses we incur in connection with such chargeback and any action undertaken to challenge the same.
All chargeback requests will be dealt with high priority. If we suspect an unauthorized transaction relating to your Liquid Account or that the account was created based on fraudulent information or for a fraudulent or illegal purpose, we may freeze the account pending further investigation and may notify you of the result of that investigation.
Authorization to Initiate Bank Transfers
Third Party Institutions
You agree Liquid may access any account you have set up through our third-party processor in connection with the Services. We may use that information to provide you with our Services, to develop our products and services, and for our internal business purposes.
Acknowledgement to Receive Email, Push Notifications or Text Messages
We may from time to time provide automatic alerts. Automatic alerts may be sent to you following certain changes made to your Account Profile or your Accounts. Electronic alerts will be sent to the contact information you have provided. If your contact information changes, you are responsible for informing us of that change. Changes to your contact information will apply to all your alerts. Because alerts are not encrypted, we will never include your password.
You understand and agree that any alerts provided to you through our Services may be delayed or prevented by a variety of factors. We do our best to provide alerts in a timely manner with accurate information. However, we neither guarantee the delivery nor the accuracy of the content of any alert. You also agree that we shall not be liable for any delays, failure to deliver, or misdirected delivery of any alert; for any errors in the content of an alert; or for any actions taken or not taken by you or any third party in reliance on an alert.
Liquid’s Intellectual Property Rights
Unless otherwise specified, the contents of our Website and our Mobile App, including, without limitation, its “look and feel” (e.g., text, graphics, images, logos and button icons), photographs, editorial content, notices, data compilation software, code and other material, are the property of Liquid Financial Services Limited and/or its affiliates, and are protected under both Ghanaian and other applicable copyright, trademark and other intellectual property laws. Unauthorized use of our content may violate copyright, trademark and other laws. You have no rights to use this content except as permitted by this agreement without prior written consent from us.
Trademarks Belonging to Liquid
The trademarks, service marks and logos used on our Website and our Mobile App are marks of Liquid Financial Services Limited. Nothing on this site should be construed as granting, by implication, or otherwise, any license or right to use these marks without our prior written permission specific for each such use. All goodwill generated from the use of our marks must be for the benefit of Liquid Financial Services Limited. Any trademarks of third parties used in connection with our Services are property of such third parties and not of Liquid.
Disclaimer Regarding Use of Mobile Devices
Use of our Services may be available through a compatible mobile device, Internet and/or network access and may require software. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees as well as the terms of your agreement with your mobile device and telecommunications provider. LIQUID MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED AS TO: (i) THE AVAILABILITY OF TELECOMMUNICATION SERVICES FROM YOUR PROVIDER AND ACCESS TO THE SERVICES AT ANY TIME OR FROM ANY LOCATION; (ii) ANY LOSS, DAMAGE, OR OTHER SECURITY INTRUSION OF THE TELECOMMUNICATION SERVICES; AND (iii) ANY DISCLOSURE OF INFORMATION TO THIRD PARTIES OR FAILURE TO TRANSMIT ANY DATA, COMMUNICATIONS OR SETTINGS CONNECTED WITH THE SERVICES.
Disclaimer of Representations and Warranties
THE CONTENT AND ALL SERVICES AND PRODUCTS ASSOCIATED WITH OUR SERVICES ARE PROVIDED TO YOU ON AN “AS-IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONTENT OR OPERATION OF OUR SERVICES. YOU EXPRESSLY AGREE THAT YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. WE MAKE NO REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY OR COMPLETENESS OF THE CONTENT ON THE LIQUID PLATFORM, AND EXPRESSLY DISCLAIM ANY WARRANTIES OF NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO REPRESENTATION, WARRANTY OR GUARANTEE THAT THE CONTENT THAT MAY BE AVAILABLE THROUGH OUR SERVICES IS FREE OF INFECTION FROM ANY VIRUSES OR OTHER CODE OR COMPUTER PROGRAMMING ROUTINES THAT CONTAIN CONTAMINATING OR DESTRUCTIVE PROPERTIES OR THAT ARE INTENDED TO DAMAGE, SURREPTITIOUSLY INTERCEPT OR EXPROPRIATE ANY SYSTEM, DATA OR PERSONAL INFORMATION.
Limitations on Liquid’s Liability
LIQUID SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO OUR SERVICES, YOUR USE OF OUR SERVICES, OR THESE TERMS AND CONDITIONS, EVEN IF LIQUID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WE RESERVE THE RIGHT TO CANCEL OR RESTRICT YOUR ACCESS TO OUR SERVICES WITHOUT NOTICE TO YOU. WE ARE NOT RESPONSIBLE FOR DAMAGES SUFFERED BY YOU OR ANY INCONVENIENCE CAUSED DIRECTLY OR INDIRECTLY BY OUR TERMINATION OF YOUR ACCESS TO OUR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, LIQUID WILL NOT ACCEPT OR HAVE ANY LIABILITY IN THE EVENT OF UNAUTHORIZED USE OF YOUR ACCOUNT, THE CONDUCT OF FRAUDULENT OR ILLEGAL ACTIVITIES VIA YOUR ACCOUNT, ANY INABILITY TO TRANSACT OR PROBLEMS RELATED TO POOR INTERNET ACCESS, MOBILE DEVICE OR COMPUTER FAILURE OR OTHER COMMUNICATION ISSUES, OR ANY ISSUES RELATED TO THE TIMELY EXECUTION OF A PAYMENT, TRANSFER, DEPOSIT OR SIMILAR.

Termination of Use
The above notwithstanding, we reserve the right, at our sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of our Services, at any time and for any reason without prior notice or liability. We reserve the right to change, suspend, or discontinue all or any part of our Services at any time without prior notice or liability.
If you do not make use of the Service for a designated amount of time, applicable laws may require Liquid to consider your account as dormant. Should this occur, we will adhere to the applicable guidelines and regulations to notify you at the contact information you provided to us. If our attempts fail and we cannot locate you, we may be required by law to block and eventually terminate your account. The funds associated with your account will be processed in accordance with the applicable laws and regulations.
